Excessive copyright rights and enforcement adversely affect that ability of creators to create content, the ability of technology companies to make innovative products, and that ability of users to use content in new ways. What's in the TPP? Well, since everyone but country negotiators and industry "advisors" have been kept in the dark, it's hard to say. But Public Knowledge has been tracking international IP issues for a number of years and a draft text was leaked in February 2011, so we can make an educated guess about what might be in the TPP's IP chapter. (The agreement also covers a vast range of other issues, including tariffs on various kinds of goods, labor standards, telecommunications, and intellectual property.) Here's an educated guess about what may be in it and how these provisions might affect you and people living in other TPP countries: Protecting incidental copies. Kicking people off the internet. The TPP would provide copyright owners power over "buffer copies." These are the small copies that computers need to make in the process moving data around. With buffer copy protection the number of transactions for which you would need a license from the copyright owner would increase a great deal. One impact of this could be that the music you stream from services such as Pandora could get much more expensive when rights holders demand higher license fees to compensate them for the "additional" copies. The TPP would encourage your ISP and the content industry to agree to institute measures such as three strikes—which kicks you off your internet connection after three accusations of copyright infringement—and deep-packet-inspection—which is akin to the USPS opening your mail. While we can not be sure exactly what is in the TPP, these examples are derived from a copy of the TPP's IP chapter that leaked in February last year, the provisions that were reported to be part of earlier drafts of ACTA, and previous free trade agreements that the US has signed. Criminalizing small scale copyright infringement. Locking out the Deaf and Blind. Under the TPP, downloading music could be considered a crime. Your computer could be seized as a device that aids this offense and your kid could be sent to jail for downloading. Some of these rules are part of US law. The TPP makes them worse and also imposes similar rules on other countries that don't have them. The TPP would prevent the blind from reading DRM protected ebooks and the deaf from inserting closed captioning onto DRM protected DVDs. In the US, the Copyright Office has made rules in the past that allows the blind to break this DRM. But the continuation of these rules is not a guarantee. And the other TPP countries could fail to make similar rules. Of course, the provisions of TPP could be much worse. We will only know if the text of the agreement is actually released to the public, something the USTR has refused to do. Meanwhile, many content industry representatives have access to the text and can work towards getting more draconian provisions into the agreement. If this process seems outrageous to you, contact the White House to let them know that such secrecy is not only unjustifiable, but unacceptable.

And I'm here to tell you today, if your going to be successful you gotta be willing to give up sleep. You gotta be willing to work with 3 hours of sleep -- 2 hours of sleep, if you really wanna be successful. Some day your gonna have to stay up 3 days in a row. Because if you go to sleep you might miss the opportunity to be successful. That's how bad you gotta (inaudible). You gotta go days without -- LISTEN TO ME! You gotta want to be successful so bad that you forget to eat. My ( ) said say, once she was on the set doing her thang, three days had gone by and she forgot that she didn't eat. There's an election today in North Dakota, and what's on the ballot isn't what you'd expect. It's an amendment to the North Dakota constitution to end altogether the property tax in that state. If I lived in north dakota, I'd vote for it. At the same time, and on the other side of the atlantic, there's interesting news out of Ireland this week - the Irish are considering *starting* a property tax - a tax on land. This is something brand new for the Irish, although it has a long history here in the united states. A few years back, i was invited to Ireland to give a speech. On the way back to the airport, a very chatty cab driver asked me a startlingly simple question, "how is it," he asked, "that you Americans aren't allowed to own land?" I asked him what he was talking about - at that time Louise and I owned a home in Atlanta, and the mortgage was nearly paid off. "It's really simple," he said. "Here in ireland I own my home and the government can never take it away from me. But in america you just rent your land from the government, and if you don't pay your property taxes, the government will take your land away and sell the right to pay rent - taxes - on it to somebody else." At that time, there was no property tax in ireland. If you lost your job, you kept your home. If you were wiped out by illness or accident or any other sort of disaster, you kept your home. The government could never take it away from you. It was that way when our nation was founded, as well. Property taxes were used in part to fund the american revolution, but they were on *all* the property you owned - your horses, cows, corn, even on slaves in the south - and on the value of your house - but usually not at all on your land. In 1818, two generations after the American revolution, Illinois became the first state to levy an equalized - standardized - property tax on land across the entire state. By 1900, 33 states had done the same. As of today, every state in the union basically owns your land and rents it to you, that rent being called property tax. And if you don't pay your rent, you lose what you thought was your land. A home and lot worth $100,000 can be seized and auctioned off for being $50 behind in property taxes. When Thomas Jefferson was president, his old friend the Marquis de Lafayette asked him to translate a book on economics by a French economist named Desuit de Tracey. Jefferson translated it into english, and sent the manuscript to Lafayette, although he begged Lafayette to keep it a secret that he'd done so because, as a sitting president, he didn't want to be seen as interfering in economic and political debates in Europe. But Jefferson translated the book because it confirmed a lot of his previous thinking.

Story : As skilled as I am at picking locks, getting the right key instead is sometimes preferable or even unavoidable. Over the years I've gathered quite a few keys that might again prove useful one day, but most of them I simply kept for the memories of jobs well done. When I looked through my collection yesterday, I discovered a golden key decorated with a skull and the numbers 6 and 7. Although I couldn't remember when or where I had obtained this particular key, I recognized its design: The very same depiction of a skull hangs over the entrance of Eastlawn Cemetery in Dayport, which likely means the key opens a crypt that's found in there. With no better job in sight for the time being, I might as well try finding the fitting lock. Who knows, maybe I'll come across a couple of sellable burial objects. Racism in the United States has been a major issue since the colonial era and the slave era. Legally sanctioned racism imposed a heavy burden on Native Americans, African Americans, Asian Americans, and Latin Americans. European Americans (particularly Anglo Americans) were privileged by law in matters of literacy, immigration, voting rights, citizenship, land acquisition, and criminal procedure over periods of time extending from the 17th century to the 1960s. Many non-Protestant European immigrant groups, particularly American Jews, Irish Americans, Italian Americans, as well as other immigrants from elsewhere, suffered xenophobic exclusion and other forms of discrimination in American society. Major racially structured institutions included slavery, Indian Wars, Native American reservations, segregation, residential schools (for Native Americans), and internment camps. Formal racial discrimination was largely banned in the mid-20th century, and came to be perceived as socially unacceptable and/or morally repugnant as well, yet racial politics remain a major phenomenon. Historical racism continues to be reflected in socio-economic inequality. Racial stratification continues to occur in employment, housing, education, lending, and government. The 20th century saw a hardening of institutionalized racism and legal discrimination against citizens of African descent in the United States. Although technically able to vote, poll taxes, acts of terror (often perpetuated by groups such as the Ku Klux Klan, founded in the Reconstruction South), and discriminatory laws such as grandfather clauses kept black Americans disenfranchised particularly in the South but also nationwide following the Hayes election at the end of the Reconstruction era in 1877. In response to de jure racism, protest and lobbyist groups emerged, most notably, the NAACP (National Association for the Advancement of Colored People) in 1909. This time period is sometimes referred to as the nadir of American race relations because racism in the United States was worse during this time than at any period before or since. Segregation, racial discrimination, and expressions of white supremacy all increased. So did anti-black violence, including lynchings and race riots. In addition, racism which had been viewed primarily as a problem in the Southern states, burst onto the national consciousness following the Great Migration, the relocation of millions of African Americans from their roots in the Southern states to the industrial centers of the North after World War I, particularly in cities such as Boston, Chicago, and New York (Harlem). In northern cities, racial tensions exploded, most violently in Chicago, and lynchings--mob-directed hangings, usually racially motivated—increased dramatically in the 1920s. As a member of the Princeton chapter of the NAACP, Albert Einstein corresponded with W. E. B. Du Bois, and in 1946 Einstein called racism America's "worst disease." The Jim Crow Laws were state and local laws enacted in the Southern and border states of the United States and enforced between 1876 and 1965. They mandated "separate but equal" status for black Americans. In reality, this led to treatment and accommodations that were almost always inferior to those provided to white Americans. The most important laws required that public schools, public places and public transportation, like trains and buses, have separate facilities for whites and blacks. (These Jim Crow Laws were separate from the 1800-66 Black Codes, which had restricted the civil rights and civil liberties of African Americans.) State-sponsored school segregation was declared unconstitutional by the Supreme Court of the United States in 1954 in Brown v. Board of Education. Generally, the remaining Jim Crow laws were overruled by the Civil Rights Act of 1964 and the Voting Rights Act; none were in effect at the end of the 1960s. Segregation continued even after the demise of the Jim Crow laws. Data on house prices and attitudes toward integration from suggest that in the mid-20th century, segregation was a product of collective actions taken by whites to exclude blacks from their neighborhoods. Segregation also took the form of redlining, the practice of denying or increasing the cost of services, such as banking, insurance, access to jobs, access to health care, or even supermarkets to residents in certain, often racially determined, areas. Hi, I'm Henry Evans, Managing Partner of Dynamic Results and as you know, I'm author of the bestselling book, "Winning with Accountability the Secret Language of High Performing Organizations". When we're out working in our client organizations, sometimes we say something, when I do it, it's usually by accident, and we get clients to say, "Wow, you should say that to all of your clients". So this month I am going to talk to you about one of those moments. We were explaining to a group of engineers in a very technical organization that we think that whatever their current business title is, the title of their position, they should start to re-frame it and think about it differently. And we said that everyone's got the same title once they are in a leadership role. It's Director of Emotional Safety. And, here's what we mean: We mean that the higher you go on the organizational chart, the more responsibility and authority you have, but, perhaps the less accountability you have. There are fewer and fewer people who are willing to tell you when you are screwing up or when you haven't kept your promises. And so, you might be operating at this point of really high leverage where you are making big decisions but you are not making them with real time information because people are afraid to come talk to you; maybe because you've chopped the head off the messenger a couple of times. We think people need to feel safe when they are bringing you bad news or you are going to be making big decisions, again, with little or no real time information. We suggest that you encourage people to point out problems in the organization if they exist even if they are with you. My team does it all the time; they point out my imperfections in most of our Monday morning huddles. So, your job is to make it safe for them to keep doing that. You want to encourage them and thank them. And we this tough love. Organizations who want to thrive are comfortable having these uncomfortable discussions when they are necessary. Now you might be thinking along the lines of this client organization I was working with during a Strategic Planning Session a few weeks ago. One of their people who might be a genius said, "What about Steve Jobs? Steve Jobs used to berate and belittle people if he didn't like their ideas." And I said, "You're right, Steve Jobs was an exception to the rule I'm offering and he achieved amazing, earth shattering, industry changing results while treating people very harshly." Then I said, "you know, I might not be an expert like all of you are, but, I don't think any of us in this room are Steve Jobs. I think he's very much the exception." So, while he could achieve those results being the way that he was in meetings, we don't think most leaders are exceptional enough that they are going to turn the world over with their ideas and have people follow them even if they are beating them up in meetings. In short, we think it is your job as a leader to create emotional safety for others so that you remain aware of what is really happening. Obama's Secret Trade Pact With The 1% -- Farewell Clean Air & Clean Water -- It's Been Nice

A draft agreement leaked Wednesday shows the Obama administration is pushing a secret trade agreement that could vastly expand corporate power. A U.S. proposal for the Trans-Pacific Partnership (TPP) trade pact between the United States and eight Pacific nations would allow foreign corporations operating in the U.S. to appeal key regulations to an international tribunal. The body would have the power to override U.S. law and issue penalties for failure to comply with its ruling. It's been branded as a trade agreement, but really it is enforceable corporate global governance. The agreement requires that every signatory country conform all of its laws, regulations and administrative procedures to what are 26 chapters of very comprehensive rules, only two of which have anything to do with trade. The other 24 chapters set a whole array of corporate new privileges and rights and handcuff governments, limit regulation. So the chapter that leaked—and it's actually now on the website of Citizens Trade Campaign --a national coalition for fair trade—that chapter is the chapter that sets up new rights and privileges for foreign investors, including their right to privately enforce this public treaty by suing our government, raiding our Treasury, over costs of complying with the same policies that all U.S. companies have to comply with. About 600 or so "corporate advisers" have access to information that even members of Congress don't. So, for two-and-a-half years, until this leak emerged, people have suspected what's going on, because, as you said, under U.S. law there are 600 official advisers, they have security clearance to see the text, they advise the U.S. position. Meanwhile, the senator, Ron Wyden, who is the chairman of the trade committee in the Senate, the committee with jurisdiction over the TPP, has been denied access to the text, as has his staff, who has security clearance, to a point where this man who has supported agreements like this in the past has filed legislation demanding he have the right to see the agreement that he's supposed to be having oversight with. He's on the Intelligence Committee, and he has security clearance, so he can see our nuclear secrets. He just can't see this corporate bill of rights that is trying to be slipped into effect in the name of being a trade agreement. It's a very elegant Trojan horse strategy. You brand it one thing, and then you put an agenda that could not survive sunshine into this agreement. I mean, the U.S. is even opposing proposals in this agreement to try and make sure countries don't have the ability to use financial regulation to ensure financial stability. So what we're talking about with this leaked chapter is literally a parallel system of justice. People have domestic laws and courts, trying to defend our rights and get our needs met. Corporations would have a parallel system of private attorneys, three of them, no conflict-of-interest laws. The U.S. and the other countries would submit themselves to the jurisdiction of this corporate kangaroo court, and these three random attorneys would have the right to order the U.S. government to pay unlimited amounts of our tax dollars to corporations and investors who, A, claim regulatory costs need to be refunded, or, B, are saying they're not being treated well enough, regardless if the policies they dislike are the exact same ones that apply to all of us. Even under NAFTA's system, which has some of this, $350 million have already been paid out to corporations by governments, over toxics bans, zoning laws, timber rules. The reason why it is so incredibly important that this agreement be exposed is this could well be the last agreement that's negotiated. So, many of your listeners and viewers have been involved in the sneaky way trade agreements have been used by corporations to limit regulation and to foster a race to the bottom since NAFTA. And each of these agreements has gotten bolder, more expansive in its limits on government regulation and in its granting of corporate powers. This one could be the end, because what they intend to do is leave it open, once it's done, for any other country to join. So, this is an agreement that ultimately could have the whole world in it as a set of binding corporate guarantees of new rights and privileges, enforced with cash sanctions and trade sanctions. It is not an exaggeration to say that the TPP threatens to become a regime of binding global governance, right at the time that the Occupy movement and movements around the world are demanding more power and control. This is the fightback. This is locking in the bad old way plus. And in addition, the way that the agreement is being negotiated, these rules would require that you not only change all of your existing laws—so good progressive laws would have to be gotten rid of—but that, in the future, you don't create new laws.

Radio host Rush Limbaugh is scratching his head at the strategy employed by Mitt Romney in the wake of his New Hampshire primary victory, as the former governor is likening himself to President Barack Obama. During an appearance on CBS, Romney said his job-cutting actions at his Bain Capital investment firm were no different from Obama's bailouts of the U.S. auto industry. "In the general election I'll be pointing out that the president took the reins at General Motors and Chrysler -- closed factories, closed dealerships laid off thousands and thousands of workers -- he did it to try to save the business," Romney said. In his analysis of the comment, Limbaugh explained, "Romney said what he did running Bain Capital was no different from what Barack Obama did bailing out the auto industry. Thud! Kerplunk! You've got to be kidding me." Limbaugh said Romney was actually accepting the premise of his critics such as fellow Republican presidential candidates Newt Gingrich and Rick Perry "that he has gone into these companies with a chainsaw." Limbaugh continued, "What Romney should've said is, 'You call what I did layoffs? I was trying to save jobs. I was trying to save companies. Look at what Obama did at General Motors. Those jobs went overseas to the Chi-coms (Chinese communists). Limbaugh added: "My concern here is that capitalism's under assault. Barack Obama is not a capitalist. Barack Obama and Romney did not do what they did for the same reasons, for the same objectives, same things. If you're going to wade intro this pool of defending the way you save a business ... you're not government. I just think there's a better way of doing this educationally, informatively than tying yourself to Obama. There's not a single thing that is common between we as conservatives and Barack Obama. Not a single thing. In the areas of economics and substance.... there's not a single thing." So...as Rush scratches his head and wonders -- we too scratch our heads and wonder. Is it a fact that Romney's job-cutting actions at his Bain Capital investment firm were REALLY no different from Obama's bailouts of the U.S. auto industry? If that is a fact -- and Romney himself apparently claims that it is a fact -- then...ipso facto -- Romney is really no different than Obama. Here we go again!
